End-User License Agreement ("EULA") for beHere

This End-User License Agreement ("EULA") is a legal agreement between you, the user, and Dario Caric ("Licensor"), the developer of the "beHere" mobile application ("Application"). This Application is provided solely for personal, non-commercial use, subject to the terms and conditions set forth below.

1. Acknowledgement

By downloading, installing, or using the Application, you agree to be bound by the terms and conditions of this EULA. The Licensor grants you a non-transferable license to use the Application on any Apple-branded product that you own or control and as permitted by the Usage Rules set forth in the Apple App Store Terms of Service.

2. Scope of License

The license granted to you for the Application is limited to a non-exclusive, non-transferable, revocable license to use the Application on Apple-branded products that you own or control. You may not distribute or make the Application available over a network where it could be used by multiple devices at the same time.

3. No Data Collection and Privacy Policy

The Application does not collect, store, transmit, or share any personally identifiable information or usage data from your device.

• Local Storage: All data generated by your use of the Application (e.g., configurations, user entries, or application states) is stored locally on your device.
• iCloud/Apple Cloud Services: If the Application utilizes Apple's iCloud or other Apple Cloud Services, all such data is stored under your personal Apple user account and is governed by Apple's own privacy policies and terms of service. The Licensor has no access to this user data.
• No Third-Party Analytics: The Application does not use any third-party analytics services or tracking mechanisms.

Due to the fundamental principle of not collecting any user data, a separate Privacy Policy is not required.

4. Maintenance and Support

The Licensor is solely responsible for providing any maintenance and support services with respect to the Application as specified in this EULA or as required under applicable law. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Application.

5. Warranty

The Licensor warrants that the Application will perform substantially in accordance with the specifications set forth on the App Store product page. In the event of any failure to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the Application to you; and that, to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Application.

6. Product Claims

You and the Licensor acknowledge that the Licensor, not Apple, is responsible for addressing any claims of the end-user or any third party relating to the Application or the end-user’s possession and/or use of that Application, including, but not limited to:

• (i) product liability claims;
• (ii) any claim that the Application fails to conform to any applicable legal or regulatory requirement; and
• (iii) claims arising under consumer protection, privacy, or similar legislation.

7. Legal Compliance

You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

9. Governing Law

This EULA is governed by the laws of the Republic of Croatia, without regard to its conflict of laws principles.
